Terms of service

These Terms of Service (“Terms”) govern your use of the einsteinptsa.org website and services operated by ALBERT EINSTEIN ELEMENTARY PTSA 2.8.24 (“we,” “us,” or “our”). By creating an account, registering a participant, purchasing a product or membership, or otherwise using the service, you agree to these Terms and our Privacy Policy.
Eligibility and Accounts
You must be at least 18 years old and legally able to enter into agreements to create an account or place an order. The service is intended for use by parents, guardians, and other authorized adults, not directly by children.
You agree to provide accurate information, keep it current, protect your account credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless caused by our failure to exercise reasonable care.
Google or Microsoft sign-in is optional and is also subject to the applicable provider’s terms. We are not responsible for the availability or operation of those providers.
Authority Regarding Participants
By registering another person, including a child, you represent that you are authorized to provide their information, make decisions concerning their participation, accept applicable policies and waivers, and receive communications regarding them.
Providing false or unauthorized information may result in cancellation without limiting other available remedies.
Registrations and Orders
Registrations and orders are subject to availability, eligibility requirements, deadlines, capacity limits, and any additional terms displayed during checkout.
An order is not final until the service confirms acceptance. We may reject or cancel an order because of ineligibility, insufficient capacity, pricing or technical errors, suspected fraud, safety concerns, or circumstances beyond our reasonable control. If we cancel a paid order, we will provide any refund required by the applicable refund policy or law.
You are responsible for reviewing order details before submission and promptly reporting errors.
Memberships
PTA memberships are subject to applicable local and Washington State PTA requirements. Membership information, including name, email address, and phone number, may be submitted to the Washington State PTA for membership administration as described in our Privacy Policy.
Payments, Fees, and Refunds
You authorize our payment processor to charge the amount shown at checkout. Payment-card information is submitted directly to the processor and is not stored by us.
Prices, fees, refund eligibility, and cancellation deadlines are disclosed during checkout or in the applicable event or refund policy. Those event-specific terms form part of these Terms and control if they conflict with a general provision here.
Except as required by law or an applicable refund policy, completed memberships, donations, registrations, and fulfilled orders are nonrefundable. Processing times and any nonrefundable third-party fees may affect the amount or timing of a refund.
Vendors and Activity Providers
We may use independent vendors, instructors, and activity providers to fulfill orders or deliver programs. Relevant order and participant information may be shared with them as described in our Privacy Policy.
A vendor may impose additional disclosed requirements concerning attendance, conduct, safety, fulfillment, or participation. Vendors are responsible for their own acts and services to the extent permitted by law. We remain responsible for obligations that applicable law does not permit us to disclaim.
Participation, Safety, and Conduct
Participants must follow applicable rules, safety instructions, eligibility requirements, and reasonable directions from authorized personnel. We may deny or end participation when reasonably necessary to protect safety, prevent disruption, enforce program rules, or address material misrepresentations.
You must disclose information specifically requested and reasonably necessary to provide an accommodation or safely administer an activity. Submission of accommodation information does not guarantee that every requested accommodation can be provided, but we will address requests in accordance with applicable law.
Activities may require a separate waiver, consent, or acknowledgment. If required, participation is conditioned on its acceptance by an authorized adult.
Acceptable Use
You may not:
Use the service unlawfully, fraudulently, or to harm another person.
Access another person’s account or information without authorization.
Interfere with the service’s security, operation, or availability.
Introduce malicious code or attempt to bypass access controls.
Scrape, copy, or use personal information obtained through the service for unauthorized purposes.
Misrepresent identity, authority, eligibility, or payment information.
Communications
You consent to receive transactional electronic communications concerning accounts, security, memberships, registrations, orders, payments, cancellations, and requested services. Marketing or optional communications are governed by the preferences and unsubscribe methods provided with those communications.
Electronic notices satisfy any requirement that a communication be provided in writing, except where applicable law requires another method.
Service Availability
We may modify, suspend, or discontinue features when reasonably necessary. We do not guarantee uninterrupted or error-free operation, but we will exercise reasonable care in operating the service.
Programs, schedules, instructors, locations, and availability may change because of enrollment, weather, facility restrictions, vendor availability, emergencies, or other circumstances. Applicable cancellation and refund policies will govern resulting refunds or credits.
Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
Nothing in these Terms excludes warranties, duties, or remedies that applicable law does not permit us to exclude.
Limitation of Liability
To the fullest extent permitted by law, we and our officers, directors, employees, and volunteers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the service.
Our aggregate liability arising from a particular order, registration, or membership will not exceed the amount you paid us for that transaction, except where applicable law prohibits that limitation or the claim results from gross negligence, willful misconduct, or another liability that cannot legally be limited.
These limitations do not alter responsibility allocated by a separately accepted activity waiver.
Suspension and Termination
You may stop using the service at any time. We may suspend or terminate access for a material violation of these Terms, unlawful conduct, security risk, nonpayment, or conduct that threatens participants or service operations.
Termination does not eliminate payment obligations or provisions that reasonably survive termination, including those concerning intellectual property, liability, disputes, and retained records.
Changes to These Terms
We may update these Terms to reflect changes in law, services, or organizational practices. We will post the revised Terms with a new effective date and provide additional notice when legally required. Changes will not retroactively alter completed transactions unless required by law or agreed by you.
Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any legal action must be brought in a state or federal court having jurisdiction where ALBERT EINSTEIN ELEMENTARY PTSA 2.8.24 is located, unless applicable law provides otherwise.
Before filing a claim, you agree to contact us and make a reasonable good-faith effort to resolve the dispute informally.
General Provisions
If any provision is unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, applicable checkout disclosures, refund policies, and accepted waivers constitute the agreement concerning the service.
